Article 1. The site

The Italian website jean paul mynè (hereinafter the site) is an e-commerce site accessible via the internet at the address www.jeanpaulmyne.com. The site can be accessed by all subjects connected to the internet system (hereinafter users). The site is owned by dima cosmetics srl, located at via annibali, 31/l, 62100 macerata and registered with the business register no. 178648 and through the site is authorized to sell cosmetic products (hereinafter the products) to users who visit the site (hereinafter users).

Within the context of these general sales conditions (hereinafter the cgv), the term parties will jointly refer to users and dima cosmetics srl. The term buyer will refer to all users who have placed an order to purchase products. The same rights and obligations provided within the cgv for users will apply to the buyer.

The sale of products through the site is intended for both personal use of users and for their professional activities, therefore users purchasing for professional use acknowledge that the value of their order must have a minimum amount of €300.00 (excluding VAT). In case the order entered is lower than the aforementioned amount, it cannot be technically processed by the electronic system. For users purchasing for personal use, there is no minimum order amount.

The products purchased on the site will be delivered both in the territory of the Italian Republic and in the following states: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom, Croatia, former Yugoslav Republic of Macedonia, Iceland, Montenegro, Serbia, Turkey, Albania, Andorra, Armenia, Azerbaijan, Belarus, Bosnia-Herzegovina, Georgia, Liechtenstein, Moldova, Principality of Monaco, Norway, Russia, Switzerland, Ukraine, USA, Canada.

Users wishing to make purchases on the site, aware of the civil and criminal responsibilities in case of false declarations, declare to be of legal age according to Italian law.

Each product purchase order made on the site implies consultation and express acceptance of the cgv, without the need for a handwritten signature by the user. In accordance with articles 1321, 1322, 1326, 1335 of the civil code, Legislative Decree no. 185/99, implementing directive 97/7/CE, and d.p.r. 513/97, the completion and submission of the order form, as per the following art. 4 order placement and confirmation methods, constitutes a legal contract of sale between dima cosmetics srl and the website user, from which mutual rights and obligations governed by civil law arise.

The user may save and print the cgv, provided that no modifications are made to them. The cgv define all the necessary steps to place an order, as described in paragraph 4 order placement and confirmation methods, and ensure the execution of said order between the parties. Dima cosmetics srl may update the cgv at any time. These cgv will apply to the exclusion of any other documents.

 

Article 2. Products

The products offered by dima cosmetics srl for sale are those listed on the site at the time users consult the site.

The photographs illustrating the products are not part of the contractual scope; therefore, dima cosmetics srl cannot be held responsible for any errors and/or discrepancies.

Despite the commitment to ensure a faithful reproduction of the colors of the products represented in the photos published on the site www.jeanpaulmyne.com compared to the originals, discrepancies are not excluded, especially due to technical limitations in computer color reproduction. Consequently, dima cosmetics srl cannot be held responsible for errors and/or inaccuracies in the graphic and photographic reproduction of the products on the site www.jeanpaulmyne.com.

Product availability: products are offered within the available stock limit. In case of unavailability of a product, the user will be informed as soon as possible. The aforementioned communication can be provided to the user: simultaneously with the order request: a window will appear informing that the chosen product is not currently available. Users can enter their email address to be informed as soon as the product becomes available again. Subsequently, prior to delivery, with the sending of an email.

If payment for an unavailable product has been made by credit card, dima cosmetics srl will refund the price of the unavailable product(s) by crediting the corresponding amount to the buyer's bank account.

If the unavailability of a product is communicated after order confirmation, the buyer will have the option to either cancel the order requesting a refund of the amount paid, which will be done within a maximum of thirty (30) days from the debit date, or request the replacement of the unavailable product by sending a related email request to the following address: ordini@dimacosmetics.it (this email address is protected from spam bots. Dima cosmetics srl cannot be held responsible in case of stock shortages or product unavailability. Dima cosmetics srl reserves the right to modify what is proposed and published on the site at any time without notice.

Property reservation. Requested products will remain the property of dima cosmetics srl until full and complete payment is received. In case of non-payment, partial payment, or incomplete payment, the buyer agrees, at their own expense, to return all purchased and delivered products upon first request from dima cosmetics srl.

Without prejudice to the above reservation of ownership, the risks related to the transportation (in particular theft and damage) of the ordered products will be borne by the buyer.

 

Article 3. Prices and payment methods

Price: product prices are indicated in euros and do not include VAT for orders for professional use, while they include VAT for orders for personal use.

The price invoiced to the buyer is the price established in the order confirmation sent via email by dima cosmetics srl.

The established price does not include delivery costs, which will be invoiced separately and specified to the user before the order is confirmed and at the time of the final confirmation.

Dima cosmetics srl reserves the right to change the prices published on the site at any time; in any case, products, subject to availability, will be invoiced based on the rates indicated at the time of order registration. The applicable rate will be that indicated on the site, except in case of typographical error.

Payments: all payments must be made immediately via the internet. Unless the server is unavailable, the user will have the option to make the payment in the following ways:

Credit card (Visa, Mastercard). The buyer must enter their credit card number, expiration date, the cardholder's name as shown on the card, and the last 3 security code numbers on the back of the card.

Paypal. Payments via PayPal are secure and fast. For PayPal, buyer privacy is a top priority. Financial data is secure because it is not shown to the seller. With PayPal, you can pay in a few clicks without having to re-enter your credit or prepaid card details for each purchase.

Cash on delivery. At the time of delivery, it will be necessary to have the order amount available in cash, or by prior arrangement before shipment with customer service, even with a non-transferable bank check.

Bank transfer. If bank transfer is selected as the payment method, after the purchase, the order summary page must be printed and sent to the fax number 0733 285843 or to the email address ordini@dimacosmetics.it (this email address is protected from spam bots. Enable JavaScript to view it), together with the receipt of the bank transfer payment. It is necessary that the order number generated by the system at the time of purchase, order date, customer name and surname, or company data be included in the bank transfer reason. The order will be processed within 24/48 hours of receiving the payment confirmation from the seller's banking system. In case of non-credit within 5 working days, the order will be automatically canceled.

In the fight against online fraud, banking operations and any other payment-related information will be checked and conducted securely through the SSL system (Secure Socket Layer), which guarantees data transmission security according to current banking procedures.

Dima cosmetics srl reserves the right to refuse all orders or deliveries in the following cases: if there is any dispute with the buyer, in case of total or partial non-payment by the buyer of a previous order, if a credit card payment request is rejected by the issuing bank, or in case of total or partial non-payment.

 

Article 4. Order placement and confirmation method

Site navigation: users can view and choose various products marketed by dima cosmetics srl at the following address: www.jeanpaulmyne.com. Users can freely consult the various site pages without any obligation to purchase.

Order registration: if a user wishes to place a purchase order, they must choose the various products of interest by clicking on the buy button.

Each new product added to the cart will be indicated by a specific window.

Users can at any time:

View the selected products and modify their order by clicking on the cart button located at the top right of each page,

Resume product selection and purchase by clicking on the cart button,

Complete product selection and order by clicking on the buy buttons.

To order the selected products, users must click on the cart button. A summary of their order will appear on the screen. If the list matches the chosen products, users must validate their choice by clicking on the proceed with the purchase buttons.

The user must identify themselves:

- by entering their email and password if they are already registered on the site,

Otherwise, they will need to register on the site.

Once the user has identified themselves, a window will appear on the screen showing: the type, quantity, and price of the products selected by the user, shipping costs, the total order amount, user details, and the delivery address for the products. The user must click in the I accept the general sales conditions box before choosing the payment method.

If the user chooses to pay by credit card, they must confirm the choice by clicking on credit card. The user must then enter their credit card details as requested on the page. The related orders will be validated after entering the credit card details on the secure page of the bank designated by dima cosmetics srl.

Order confirmation: once the buyer has validated their order and given instructions for payment, a summary window with the transaction number will appear. This confirmation will also be sent to the buyer in the order confirmation email. The confirmation will include all elements of the contract between the parties, including the requested goods, payment provisions, delivery provisions, information regarding the buyer's right to cancel an order, and dima cosmetics srl's address for any complaints. It is advisable to keep a copy (electronic or paper) of the order information.

Once the order is ready and has been shipped, a confirmation email of the shipment will be sent to the buyer.

The data recorded and collected on the site constitute full proof of all transactions concluded between the buyer and dima cosmetics srl. In case of dispute between dima cosmetics srl and the buyer regarding a transaction carried out on the site, the data recorded by dima cosmetics srl will constitute full proof of the transaction contents and details.

 

Article 5. Delivery

Terms and conditions for delivery

Orders will be organized by the logistics center and subsequently shipped by the shipping service. The average time required to receive the ordered products is approximately 2/3 working days from the date the order is received.

In any case, orders will be delivered within a maximum of thirty (30) days from the date of order confirmation by the user.

The products ordered by the buyer will be delivered to the address indicated by the buyer on the order form. The buyer must provide the correct residential and/or domicile address when ordering products.

Delivery-related issues

Dima cosmetics will not be responsible for delays in delivery caused by transport services or in cases of loss of ordered products. In case of delivery delay, the buyer must inform dima cosmetics srl as soon as possible by sending an email to ordini@dimacosmetics.it (this email address is protected from spam bots. Enable JavaScript to view it) or by calling the number [0733/280228 from Monday to Friday from 9 am to 6 pm]. Dima cosmetics will contact the shipping service to initiate an investigation, the duration of which is unpredictable.

After receiving the ordered products, the buyer must verify that the products correspond to those ordered. Any anomalies found (missing or damaged products, damaged shipping package, etc.) must be noted by the buyer on a form inside the shipping package, which must be sent to dima cosmetics srl's customer service (by sending an email to ordini@dimacosmetics.it or by calling the number [0733/280228 from Monday to Friday from 9 am to 1 pm and from 2 pm to 6 pm]), specifying that there is no correspondence between the ordered and received products.

All complaints sent more than 10 working days after the delivery date will be rejected, and dima cosmetics srl will be released from any liability.

 

Article 6. Right of withdrawal

Products must be returned by mail to the following address:

Products that do not satisfy the consumer. The buyer has 7 days to return the products, at their own expense, if the products do not satisfy them. The cancellation period for the order starts from the day the order is received until the seventh day after the buyer receives the goods. The products must be returned in their original packaging and accompanied by the transport document, addressing everything to the following address: dima cosmetics srl - via annibali, 31/l - 62100 macerata - Italy

Dima cosmetics srl will not accept parcels for which transport costs have not been paid. All risks related to the return of products will be borne by the buyer.

If the above conditions are met, dima cosmetics will refund the buyer, within a maximum period of thirty (30) days from the date of the order cancellation communication, the corresponding purchase amount. All non-conforming products must be returned by mail to dima cosmetics srl within 7 working days from the date of receipt, in their original packaging, accompanied by the transport document.

The transportation costs will be borne by dima cosmetics srl if the decision to return the products results from an error by dima cosmetics srl.

Upon receiving the products presumed to be non-conforming, dima cosmetics srl will examine these products as soon as possible. If the non-conformity of the products is confirmed, dima cosmetics srl will replace or refund the defective or missing products. In the case of product refunds, the buyer will be reimbursed within 30 days from the date of confirmation for an amount corresponding to the price of the purchased products, in addition to the cost incurred for the return.

 

Article 7. Personal information

Dima cosmetics srl informs that personal data collected through order forms are processed for purposes related to order fulfillment, customer relationship management, promotional activities, and in general to carry out its commercial activities.

In relation to the purposes indicated, the processing of personal data may take place through paper media, computer tools, or telematic systems. Providing personal data is mandatory, and the refusal to complete even one of the mandatory fields will result in order cancellation.

 

Article 8. Force majeure

None of the parties will be liable for total or partial non-performance or delay in the performance of their obligations under this contract caused by an event that cannot be prevented (force majeure).

Force majeure events may include, by way of example, wars, riots, uprisings, serious internet security disturbances, technical failures, unauthorized access and/or intrusions into website servers, strikes of any kind, telematic or telephone failures.

If a party believes that a force majeure event has occurred, they must inform the other party within 5 working days from the event occurrence or the risk of such occurrence.

The parties agree to meet in order to jointly determine the terms and conditions for order processing during the presence of a force majeure event.

After one (1) month of interruption due to a force majeure event, dima cosmetics srl may choose to cancel orders and refund the buyer, if necessary.
